Shipping & Trasport Law
Transportation and logistics are an indispensable and vital aspect for many businesses today. As the global market continues to grow, businesses succeed or fail on the strength or otherwise of their transportation and logistics solutions. It is of crucial importance that goods reach their intended destinations without incidents or delay. With such high stakes, it is important that businesses and commercial trading companies nail their rights and obligations down to the ground because making mistakes can be costly.
These are exciting times. With the Shipping Industry on the verge of a seismic change in the rules governing the carriage of goods by sea by the introduction of the Draft Contract for the International Carriage of Goods Wholly or Partly by Sea (the Draft Convention) be presented to the UN General Assembly this autumn for adoption after which the Draft Convention will be opened for Signature in Rotterdam in 2009 and thereafter ratification and accession. This is the culmination of the body of work drafted by the Comite Maritime International and the UN Commission on International Trade Law (UNCITRAL).
With the imminent introduction of the first multimodal convention these are also uncertain times. The new convention widely expected to be ratified in 2009 will do away with the familiar liability regime under The Hague, Hague-Visby and Hamburg rules, leaving areas of ambiguity in its wake.
